       Senator Stewart moved the following:
       
    1         Senate Amendment to Amendment (318628) (with title
    2  amendment)
    3  
    4         Between lines 436 and 437
    5  insert:
    6         Section 13. Section 790.30, Florida Statutes, is created to
    7  read:
    8         790.30Assault weapons; permit; fee.—
    9         (1)As used in this section, the term assault weapon”
   10  means:
   11         (a) A selective-fire firearm capable of fully automatic,
   12  semiautomatic, or burst fire at the option of the user.
   13         (b)A part or combination of parts that convert a firearm
   14  into an assault weapon, or any combination of parts from which
   15  an assault weapon may be assembled if those parts are in the
   16  possession or under the control of the same person.
   17         (c)A semiautomatic firearm which meets the criteria of one
   18  of the following sub-subparagraphs:
   19         1.A semiautomatic rifle that has an ability to accept a
   20  detachable magazine and that has one or more of the following:
   21         a.A folding or telescoping stock.
   22         b.A pistol grip that protrudes conspicuously beneath the
   23  action of the weapon or any feature functioning as a protruding
   24  grip that can be held by the nontrigger hand or a thumbhole
   25  stock.
   26         c.A bayonet mount.
   27         d.A flash suppressor or threaded barrel designed to
   28  accommodate a flash suppressor.
   29         e.A grenade launcher.
   30         f.A shroud that is attached to the barrel, or that
   31  partially or completely encircles the barrel and allows the
   32  bearer to hold the firearm with the nontrigger hand without
   33  being burned, but excluding a slide that encloses the barrel.
   34         2.A semiautomatic pistol that has an ability to accept a
   35  detachable magazine and that has one or more of the following:
   36         a.The capacity to accept an ammunition magazine that
   37  attaches to the pistol at any location outside the pistol grip.
   38         b.A threaded barrel capable of accepting a barrel
   39  extender, flash suppressor, forward handgrip, or silencer.
   40         c.A slide that encloses the barrel and that allows the
   41  shooter to hold the firearm with the nontrigger hand without
   42  being burned.
   43         d.A manufactured weight of 50 ounces or more when the
   44  pistol is unloaded.
   45         e.A semiautomatic version of an automatic firearm.
   46         f.Any feature capable of functioning as a protruding grip
   47  that can be held by the nontrigger hand.
   48         g.A folding, telescoping, or thumbhole stock.
   49         3.A semiautomatic shotgun that has one or more of the
   50  following:
   51         a.A folding or telescoping stock.
   52         b.A pistol grip that protrudes conspicuously beneath the
   53  action of the weapon.
   54         c.A thumbhole stock.
   55         d.A fixed-magazine capacity in excess of 5 rounds.
   56         e.An ability to accept a detachable magazine.
   57         4.A semiautomatic pistol or a semiautomatic, centerfire,
   58  or rimfire rifle with a fixed magazine that has the capacity to
   59  accept more than 10 rounds of ammunition.
   60         5.A part or combination of parts designed or intended to
   61  convert a firearm into an assault weapon, or any combination of
   62  parts from which an assault weapon may be assembled if those
   63  parts are in the possession or under the control of the same
   64  person.
   65         (2) The Department of Law Enforcement shall issue a permit
   66  for ownership of an assault weapon to an applicant who submits a
   67  completed application and a one-time fee of $1,000, after the
   68  applicant has met the requirements of s. 790.065.
   69         (3) By January 1, 2020, all persons who own an assault
   70  weapon in this state must hold a valid permit for ownership of
   71  an assault weapon issued pursuant to this section. A person who
   72  violates this subsection commits a misdemeanor of the first
   73  degree, punishable as provided in s. 775.082 or s. 775.083.
   74         (4)The Department of Law Enforcement must adopt rules and
   75  procedures to administer this section.

   80  and insert:
   81         criminal penalties; creating s. 790.30, F.S.; defining
   82         the term “assault weapon”; requiring the department to
   83         issue a permit for ownership of an assault weapon to
   84         an applicant under certain circumstances; requiring
   85         all persons who own an assault weapon in this state to
   86         hold a valid permit before a specified date; providing
   87         criminal penalties; requiring the department to adopt
   88         rules and procedures; providing legislative intent;
