Senator Simmons moved the following:

4 Delete lines 368 - 378
5 and insert:
6 (13)(a) A person younger than 21 years of age may not
7 purchase an assault weapon. The sale or transfer of an assault
8 weapon to a person younger than 21 years of age may not be
9 knowingly and intentionally made or facilitated by any person,
10 including a licensed importer, licensed manufacturer, or
11 licensed dealer. A person who violates this subsection commits a
12 felony of the third degree, punishable as provided in s.
13 775.082, s. 775.083, or s. 775.084. Solely for the purposes of
14 this paragraph, the term “assault weapon” means a fully
15 automatic or semiautomatic rifle or shotgun that has a fixed
16 magazine capacity of more than 10 rounds of centerfire
17 ammunition. The term also includes a semiautomatic rifle or
18 shotgun when it is loaded with a detachable magazine having a
19 capacity of more than 10 rounds of centerfire ammunition or when
20 the rifle or shotgun is possessed by a person under 21 years of
21 age who also possesses a detachable magazine for the rifle or
22 shotgun which has a capacity of more than 10 rounds of
23 centerfire ammunition.
24 (b) The prohibitions in paragraph (a) do not apply to the
25 purchase of a rifle or shotgun by a law enforcement officer or
26 correctional officer, as those terms are defined in s.
27 943.10(1), (2), (3), (6), (7), (8), or (9), or to a
28 servicemember as defined in s. 250.01. This paragraph expires on
29 July 1, 2021, unless renewed by the Legislature.

36 knowing and intentional sale or transfer, or
37 facilitation of a sale or transfer, of an assault
38 weapon to a person younger than a certain age by any
39 person, including a licensed importer, licensed
40 manufacturer, or licensed dealer; providing criminal
41 penalties; defining the term “assault weapon”;
42 providing exceptions; providing a repeal date for such
43 exceptions; amending s. 790.0655, F.S.; revising the
