Florida Senate - 2018 SJR 790 By Senator Lee 20-01006-18 2018790__ 1 Senate Joint Resolution 2 A joint resolution proposing an amendment to Section 2 3 of Article IV and the creation of a new section in 4 Article XII of the State Constitution to require the 5 Lieutenant Governor to serve as the Secretary of 6 State, to specify the secretary’s duties, and to 7 authorize the Lieutenant Governor to cast tiebreaking 8 votes on any measure on which the Senate is equally 9 divided. 10 11 Be It Resolved by the Legislature of the State of Florida: 12 13 That the following amendment to Section 2 of Article IV and 14 the creation of a new section in Article XII of the State 15 Constitution are agreed to and shall be submitted to the 16 electors of this state for approval or rejection at the next 17 general election or at an earlier special election specifically 18 authorized by law for that purpose: 19 ARTICLE IV 20 EXECUTIVE 21 SECTION 2. Lieutenant governor.—There shall be a lieutenant 22 governor, who shall: 23 (a) Serve as the secretary of state and keep the records of 24 the official acts of the legislative and executive departments. 25 (b) Have authority to cast the tiebreaking vote on final 26 passage of any measure on which the senate is equally divided. 27 (c) Perform such duties pertaining to the office of 28 governor as shall be assigned by the governor, except when 29 otherwise provided by law, and such other duties as may be 30 prescribed by law. 31 ARTICLE XII 32 SCHEDULE 33 Duties of the lieutenant governor.—The amendment to Section 34 2 of Article IV, relating to the duties of the lieutenant 35 governor, and the creation of this section shall take effect 36 January 8, 2019. Upon the effective date of this amendment, the 37 term “secretary of state” shall be substituted for the term 38 “custodian of state records” throughout the constitution, except 39 for Article XII. 40 BE IT FURTHER RESOLVED that the following statement be 41 placed on the ballot: 42 CONSTITUTIONAL AMENDMENT 43 ARTICLE IV, SECTION 2 44 ARTICLE XII 45 DUTIES OF THE LIEUTENANT GOVERNOR.—Proposing an amendment 46 to the State Constitution requiring the Lieutenant Governor to 47 serve as the Secretary of State and specifying that the 48 Secretary of State shall keep the records of the official acts 49 of the legislative and executive departments of state 50 government. This amendment also authorizes the Lieutenant 51 Governor to cast a tiebreaking vote on final passage of any 52 measure on which the Senate is equally divided.
