Florida Senate - 2018 SB 802 By Senator Garcia 36-00786-18 2018802__ 1 A bill to be entitled 2 An act relating to drug and violence prevention 3 programs; creating s. 1006.149, F.S.; requiring each 4 school district to implement a drug and violence 5 prevention program by a specified school year for 6 certain students; providing the purpose of the 7 program; providing program requirements; providing for 8 funding; authorizing the State Board of Education to 9 adopt rules; providing an effective date. 10 11 Be It Enacted by the Legislature of the State of Florida: 12 13 Section 1. Section 1006.149, Florida Statutes, is created 14 to read: 15 1006.149 Drug and violence prevention programs.— 16 (1) In order for Florida’s schools to remain healthy 17 learning environments and to provide a strong defense against 18 drug use and violence, beginning in the 2018-2019 school year, 19 each school district, in partnership with the county sheriff’s 20 office, shall implement a drug and violence prevention program 21 for students in grade 5. The purpose of the program is to: 22 (a) Prevent students from illegally using alcohol, tobacco, 23 and other drugs. 24 (b) Reduce or eliminate the incidence and prevalence of 25 students’ alcohol, tobacco, and other drug abuse. 26 (c) Reduce the factors that place students at risk of 27 abusing alcohol, tobacco, and other drugs. 28 (d) Contribute to the development of school environments 29 and alternative activities that are alcohol-, tobacco-, and 30 drug-free. 31 (e) Increase the knowledge and skills of students to avoid 32 the harmful effects of alcohol, tobacco, and drug use. 33 (f) Facilitate an understanding and appreciation of the 34 risks to, duties of, and likely actions by law enforcement 35 officers when conducting investigations. 36 (g) Instruct students on how to interact with a law 37 enforcement officer during a vehicular or other stop or police 38 interaction, including problematic or dangerous actions and 39 behaviors that could result in a person being detained or 40 arrested. 41 (2) The program must include a 15-week curriculum, be 42 selected or created by the county sheriff’s office, and be age 43 appropriate for students. 44 (3) Fifty percent of the funding for the program shall be 45 provided by the county sheriff’s office and 50 percent shall be 46 provided by the district school board. 47 (4) The State Board of Education may adopt rules to 48 administer this section. 49 Section 2. This act shall take effect July 1, 2018.
