Floor: WD/2R . 03/08/2018 05:32 PM . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— Senator Brandes moved the following: 1 Senate Amendment (with title amendment) 2 3 Delete lines 1824 - 1857 4 and insert: 5 (g) An amendment to any governing document enacted after 6 July 1, 2018, that prohibits a parcel owner from renting the 7 home, alters the authorized duration of a rental term, or 8 specifies or limits the number of times that a parcel owner may 9 rent their home during a specified term, applies only to a 10 parcel owner who acquires title to the home after the effective 11 date of the amendment or to a parcel owner who consents, 12 individually or through a representative, to the amendment. For 13 purposes of this paragraph, a change of ownership does not occur 14 when a parcel owner conveys the parcel to an affiliated entity 15 or when beneficial ownership of the parcel does not change. For 16 purposes of this paragraph, the term “affiliated entity” means 17 an entity which controls, is controlled by, or is under common 18 control with the parcel owner or that becomes a parent or 19 successor entity or an entity under common control, including an 20 entity that becomes a parent or successor entity of the parcel 21 owner by reason of transfer, merger, consolidation, public 22 offering, reorganization, dissolution or sale of stock, or 23 transfer of membership partnership interests.
