The Committee on Communications, Energy, and Public Utilities
(Clemens) recommended the following:
1 Senate Amendment (with directory and title amendments)

3 Between lines 30 and 31
4 insert:
5 (6) A law enforcement officer shall inform a person who is
6 stopped for texting while driving of the person’s right to
7 decline a search of his or her wireless communications device.

10 And the directory clause is amended as follows:
11 Delete line 16
12 and insert:
13 (5) of section 316.305, Florida Statutes, are amended, and
14 subsection (6) is added to that section, to read:

17 And the title is amended as follows:
18 Delete line 11
19 and insert:
20 as a secondary action; requiring a law enforcement
21 officer to inform a person who is stopped for texting
22 while driving of the person’s right to decline a
23 search of his or her wireless communications device;
24 providing an effective date.
