    2         An act relating to inmate placement; amending s.
    3         944.17, F.S.; requiring the Department of Corrections
    4         to confine inmates according to specified locational
    5         requirements by a specified date; providing an
    6         exception; providing an effective date.

    8  Be It Enacted by the Legislature of the State of Florida:
    9  
   10         Section 1. Subsection (2) of section 944.17, Florida
   11  Statutes, is amended to read:
   12         944.17 Commitments and classification; transfers.—
   13         (2)(a) The department shall direct each prisoner committed
   14  to the custody of the department to shall be conveyed to an such
   15  institution, a facility, or a program in the correctional system
   16  as the department shall direct, in accordance with its
   17  classification scheme and the requirements imposed in paragraph
   18  (b).
   19         (b) By July 1, 2022, the department shall, subject to the
   20  inmate’s custody classification, programmatic needs, and mental
   21  and medical health needs, place each inmate in an institution or
   22  a facility as close as practicable to within 125 driving miles
   23  of the inmate’s primary residence. Subject to the inmate’s
   24  custody classification, the department shall transfer an inmate
   25  to an institution or a facility that is as close as practicable
   26  to within 125 driving miles of the inmate’s primary residence,
   27  unless the inmate chooses to remain at his or her current
   28  institution or facility. This paragraph does not apply to an
   29  inmate who has a department custody classification of close
   30  custody or maximum custody.
   31         Section 2. This act shall take effect July 1, 2019.
