    1                        A bill to be entitled                      
    2         An act relating to assignment of consumer debts;
    3         amending s. 559.715, F.S.; clarifying that an assignee
    4         must give a debtor certain notice within a specified
    5         timeframe before the assignee brings legal action to
    6         collect the debt; providing an effective date.

    8  Be It Enacted by the Legislature of the State of Florida:
    9  
   10         Section 1. Section 559.715, Florida Statutes, is amended to
   11  read:
   12         559.715 Assignment of consumer debts.—This part does not
   13  prohibit the assignment, by a creditor, of the right to bill and
   14  collect a consumer debt. However, the assignee must give the
   15  debtor written notice of such assignment as soon as practical
   16  after the assignment is made, but at least 30 days before
   17  bringing any legal action to collect the debt. The assignee is a
   18  real party in interest and may bring an action to collect a debt
   19  that has been assigned to the assignee and is in default.
   20         Section 2. This act shall take effect July 1, 2019.
