       The Committee on Judiciary (Rodriguez) recommended the
       following:
       
    1         Senate Amendment to Amendment (748114) 
    2  
    3         Delete line 50
    4  and insert:
    5         (b) A property insurance policy may not require a consumer
    6  to mitigate damages in an amount greater than any cap imposed
    7  under the policy, including the caps on the service provider’s
    8  right to payment under subparagraph (a)1.
    9         (c) To the extent that an agreement between a consumer and
