1 A bill to be entitled
2 An act relating to the treatment of sexual assault
3 victims; amending s. 395.1021, F.S.; requiring certain
4 licensed facilities to provide to victims of sexual
5 assault information regarding emergency contraception
6 and its availability, if requested; providing a
7 definition; providing an effective date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Subsection (1) of section 395.1021, Florida
12 Statutes, is amended to read:
13 395.1021 Treatment of sexual assault victims.—Any licensed
14 facility which provides emergency room services shall arrange
15 for the rendering of appropriate medical attention and treatment
16 of victims of sexual assault through:
17 (1) Such Gynecological, psychological, and medical services
18 that may include, but are not limited to, providing to such
19 victims, verbally and in writing, medically and factually
20 accurate information regarding emergency contraception,
21 including its use, efficacy, and availability at the facility,
22 if requested as are needed by the victim. For purposes of this
23 subsection, the term “emergency contraception” means a drug,
24 medicine, oral hormonal compound, mixture, preparation,
25 instrument, article, or device that is approved by the United
26 States Food and Drug Administration and prevents a pregnancy
27 after sexual intercourse. The term does not include a drug,
28 medicine, oral hormonal compound, mixture, preparation,
29 instrument, article, or device of any nature which is prescribed
30 for the purpose of terminating a pregnancy.

32 Such licensed facility shall also arrange for the protection of
33 the victim’s anonymity while complying with the laws of this
34 state and may encourage the victim to notify law enforcement
35 personnel and to cooperate with them in apprehending the
36 suspect.
37 Section 2. This act shall take effect July 1, 2019.
