    1                        A bill to be entitled                      
    2         An act relating to a notice of tobacco smoking policy
    3         on rental premises; creating s. 83.491, F.S.;
    4         requiring certain persons to provide written notice of
    5         the tobacco smoking policy to a tenant or potential
    6         tenant that includes certain information before
    7         entering into a rental agreement; requiring such
    8         persons to obtain written acknowledgment of receipt of
    9         the notice before entering into a rental agreement;
   10         providing an effective date.
   11          
   12  Be It Enacted by the Legislature of the State of Florida:
   13  
   14         Section 1. Section 83.491, Florida Statutes, is created to
   15  read:
   16         83.491 Notice of tobacco smoking policy on rental
   17  premises.—Before entering into a rental agreement, the landlord,
   18  or a person authorized to enter into a rental agreement on the
   19  landlord’s behalf, must provide written notice of the tobacco
   20  smoking policy to the tenant or potential tenant stating whether
   21  tobacco smoking is authorized, prohibited, or limited to
   22  specified areas on the premises. If tobacco smoking is limited
   23  to specified areas, the notice must clearly specify the areas in
   24  which smoking is authorized. The landlord, or a person
   25  authorized to enter into a rental agreement on the landlord’s
   26  behalf, must obtain written acknowledgment of receipt of the
   27  notice from the tenant or potential tenant before entering into
   28  the rental agreement.
   29         Section 2. This act shall take effect July 1, 2019.
