House Comm: WD . 04/03/2019 . . . . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— The Committee on Community Affairs (Farmer) recommended the following: 1 Senate Amendment to Amendment (694068) (with title 2 amendment) 3 4 Delete lines 75 - 93 5 and insert: 6 (1) From March 1 through June 1 of the calendar year, a 7 local government may not enforce an ordinance or regulation 8 governing the pruning or trimming of specimen, heritage, or 9 patriarch trees, as defined by local ordinances or regulations, 10 or the pruning, trimming, or removal of other trees on 11 residential property which requires a permit, an application, 12 the provision of notice, a fee, or a fine if the property owner 13 has obtained documentation from an arborist certified by the 14 International Society of Arboriculture or a Florida licensed 15 landscape architect that the tree is a danger to persons or 16 property and the tree is not a listed endangered species. 17 (2) A local government may enforce ordinances or 18 regulations pertaining to the replanting of trees that have been 19 removed in accordance with this section. 20 (3) This section does not apply to the exercise of 21 specifically delegated authority for mangrove protection 22 pursuant to ss. 403.9321-403.9333. 23 24 ================= T I T L E A M E N D M E N T ================ 25 And the title is amended as follows: 26 Delete lines 110 - 113 27 and insert: 28 authorizing a local government to enforce ordinances 29 or regulations pertaining to the replanting of trees 30 under certain circumstances; providing applicability; 31 providing
