Section 163.3214, Florida Statutes, is created 6 to read: 7 163.3214 Tree pruning, trimming, or removal on single 8 family residential property.— 9 (1) A local government may not require a permit, an 10 application, the provision of a notice, a fee, or impose a fine: 11 (a) For the pruning, trimming, or removal of a tree on a 12 single-family residential property if the property owner has 13 obtained documentation from an arborist certified by the 14 International Society of Arboriculture or a Florida licensed 15 landscape architect that the tree is a danger to persons or 16 property and the tree is not a specimen, heritage, or patriarch 17 tree, as defined by local ordinances or regulations. 18 (b) For the pruning or trimming of a specimen, heritage, or 19 patriarch tree, as defined by local ordinances or regulations, 20 on a single-family residential property if the property owner 21 has obtained documentation from an arborist certified by the 22 International Society of Arboriculture or a Florida licensed 23 landscape architect that the tree is a danger to persons or 24 property. 25 (2) A local government may enforce ordinances or 26 regulations pertaining to the replacement of trees that have 27 been removed in accordance with this section.
