       Senator Diaz moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete lines 503 - 517
    4  and insert:
    5         Section 6. Paragraphs (g) and (h) are added to subsection
    6  (1) and paragraph (i) is added to subsection (7) of section
    7  1012.796, Florida Statutes, and subsection (10) is added to that
    8  section, to read:
    9         1012.796 Complaints against teachers and administrators;
   10  procedure; penalties.—
   11         (1)
   12         (g) A district school board, charter school governing
   13  board, or private school that accepts scholarship students who
   14  participate in a state scholarship program under chapter 1002
   15  shall immediately report any legally sufficient complaint that
   16  involves misconduct by an employee or contracted personnel which
   17  affects the health, safety, or welfare of a student and would
   18  otherwise result in the permanent revocation of a certificate to
   19  the department for placement on the disqualification list.
   20         (h) The commissioner may withhold certain funding from any
   21  school district, charter school, or private school that
   22  participates in a state scholarship program under chapter 1002
   23  which fails to report any legally sufficient complaint that
   24  involves misconduct by an employee or contracted personnel.
