       Senator Diaz moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Between lines 78 and 79
    4  insert:
    5         Section 2. Paragraph (b) of subsection (5) of section
    6  1001.42, Florida Statutes, is amended to read:
    7         1001.42 Powers and duties of district school board.—The
    8  district school board, acting as a board, shall exercise all
    9  powers and perform all duties listed below:
   10         (5) PERSONNEL.—
   11         (b) Immediately investigate any legally sufficient
   12  complaint that involves misconduct by an educational support
   13  employee as defined in s. 1012.40(1)(a) or a substitute teacher
   14  employed pursuant to s. 1012.35 which affects the health,
   15  safety, or welfare of a student and would otherwise result in
   16  termination. An investigation that results in termination must
   17  be reported to the department for placement on the
   18  disqualification list. The commissioner may withhold certain
   19  funding from any school district or charter school that fails to
   20  report any legally sufficient complaint that involves misconduct
   21  by an employee or contracted personnel which affects the health,
   22  safety, or welfare of a student.
   23         (c) Notwithstanding s. 1012.55 or any other provision of
   24  law or rule to the contrary and consistent with adopted district
   25  school board policy relating to alternative certification for
   26  school principals, have the authority to appoint persons to the
   27  position of school principal who do not hold educator
   28  certification.
