Florida Senate - 2019 SB 1560 By Senator Flores 39-01638-19 20191560__ 1 A bill to be entitled 2 An act relating to price transparency in contracts; 3 creating s. 627.4303, F.S.; defining the term “health 4 insurer”; providing that a contract between a health 5 insurer and a health care provider may not limit 6 certain disclosures and must prohibit the insurer from 7 requiring payments for services from an insured which 8 exceed certain amounts; providing an effective date. 9 10 Be It Enacted by the Legislature of the State of Florida: 11 12 Section 1. Section 627.4303, Florida Statutes, is created 13 to read: 14 627.4303 Price transparency in contracts between health 15 insurers and health care providers.— 16 (1) As used in this section, the term “health insurer” has 17 the same meaning as in s. 627.4301. 18 (2) A contract between a health insurer and a health care 19 provider may not limit a provider’s ability to disclose whether 20 a patient’s cost-sharing obligation exceeds the retail price for 21 a covered service or to disclose the availability of a more 22 affordable service. 23 (3) A contract between a health insurer and a health care 24 provider must prohibit the insurer from requiring an insured to 25 make a payment for a service in an amount that exceeds the 26 retail price of the service in the absence of health insurance. 27 Section 2. This act shall take effect July 1, 2019.
