Florida Senate - 2019 SB 1608 By Senator Baxley 12-01764-19 20191608__ 1 A bill to be entitled 2 An act relating to funding for nonprofit coordinating 3 entities; creating s. 984.25, F.S.; requiring the 4 Department of Financial Services to contract with a 5 nonprofit coordinating entity for certain services; 6 providing for carry forward of a certain amount of 7 unexpended state funds; providing restrictions on the 8 use of such funds; requiring that expenditures of such 9 funds be reported to the department; authorizing 10 advanced payment on such a contract for a specified 11 amount; providing requirements for certain 12 disbursements; providing an effective date. 13 14 Be It Enacted by the Legislature of the State of Florida: 15 16 Section 1. Section 984.25, Florida Statutes, is created to 17 read: 18 984.25 Funding for nonprofit coordinating entities.— 19 (1) The Department of Financial Services shall contract 20 with a nonprofit coordinating entity to serve sexually exploited 21 and trafficked victims between the ages of 10 and 24 years. The 22 contract shall be funded by general revenue or other applicable 23 funds or applicable federal funding sources. The coordinating 24 entity may carry forward documented unexpended state funds from 25 one fiscal year to the next. The cumulative amount carried 26 forward may not exceed 8 percent of the annual contract for 27 general revenue. Any unexpended state funds in excess of that 28 percentage shall be returned to the department. The funds 29 carried forward may not be used in a way that would increase 30 future recurring obligations or for any program or service that 31 was not authorized under the existing contract with the 32 department. Expenditures of funds carried forward shall be 33 separately reported to the department. Funds carried forward may 34 be retained through contract renewals and new contract 35 procurements. 36 (2) The method of payment for a fixed-price contract with 37 the nonprofit coordinating entities shall provide for a 3-month 38 advance payment at the beginning of each fiscal year pursuant to 39 s. 216.181(16) in order to provide goods and services essential 40 to the operation of the contracted activities. Thereafter, 41 disbursements shall only be on a reimbursement basis. 42 Section 2. This act shall take effect July 1, 2019.
