Floor: 1B/F/2R . 04/26/2019 12:14 PM . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— Senator Powell moved the following: 1 Senate Amendment to Amendment (368506) (with title 2 amendment) 3 4 Delete line 278 5 and insert: 6 (14) RECIPIENTS.— 7 (a) Due to the dangers and risks associated with untested 8 foreign drugs imported through the program, the following 9 persons may not be forced to participate in the program and must 10 be given an opportunity to opt out of the program: 11 1. Pregnant women; 12 2. Minor children participating in Medicaid; 13 3. Persons with developmental disabilities; 14 4. Inmates in the custody of the Department of Corrections; 15 5. Senior persons over the age of 65; and 16 6. Psychiatric patients who are stable on their medication. 17 (b) Recipients of prescription drugs through the program 18 must be notified that they are receiving prescriptions drugs 19 through the program and that there may be unknown dangers and 20 risks of death or harm from using such drugs. 21 (15) RULEMAKING.—The agency shall adopt rules necessary to 22 23 ================= T I T L E A M E N D M E N T ================ 24 And the title is amended as follows: 25 Between lines 1197 and 1198 26 insert: 27 prohibiting certain persons from being forced to 28 participate in the program and requiring that they be 29 given an opportunity to opt out; requiring that 30 recipients of prescription drugs through the program 31 be given a certain notification;
