House Comm: RCS . 04/18/2019 . . . . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— The Committee on Appropriations (Stargel) recommended the following: 1 Senate Amendment to Amendment (107176) (with directory and 2 title amendments) 3 4 Between lines 126 and 127 5 insert: 6 (3) POWERS AND DUTIES RELATING TO ORGANIZATION AND 7 OPERATION OF STATE UNIVERSITIES.— 8 (j) The Board of Governors shall develop and annually 9 deliver a training program for members of each state university 10 board of trustees that addresses the role of such boards in 11 governing institutional resources and protecting the public 12 interest. At a minimum, each trustee must participate in the 13 training program within 1 year of appointment and reappointment 14 to a university board of trustees. The program must include 15 information on trustee responsibilities relating to all of the 16 following: 17 1. Meeting the statutory, regulatory, and fiduciary 18 obligations of the board. 19 2. Establishing internal process controls and 20 accountability mechanisms for the institution’s president and 21 other administrative officers. 22 3. Oversight of planning, construction, maintenance, 23 expansion, and renovation projects that impact the university’s 24 consolidated infrastructure, physical facilities, and natural 25 environment, including its lands, improvements, and capital 26 equipment. 27 4. Establishing policies that promote college 28 affordability, including ensuring that the costs of university 29 fees, textbooks, and instructional materials are minimized 30 whenever possible. 31 5. Creation and implementation of institutionwide rules and 32 regulations. 33 6. Institutional ethics and conflicts of interest. 34 7. Best practices for board governance. 35 8. Understanding current national and state issues in 36 higher education. 37 9. Any other responsibilities the Board of Governors deems 38 necessary or appropriate. 39 (5) POWERS AND DUTIES RELATING TO ACCOUNTABILITY.— 40 (f) If the Board of Governors of the State University 41 System, the presiding officer of either house of the 42 Legislature, the Chief Financial Officer, or a member of the 43 board of trustees of the institution for which an investigation 44 is sought determines that a state university board of trustees 45 is unwilling or unable to address substantiated allegations made 46 by any person relating to waste, fraud, or financial 47 mismanagement within the state university, the Office of the 48 Inspector General shall investigate the allegations. 49 50 ====== D I R E C T O R Y C L A U S E A M E N D M E N T ====== 51 And the directory clause is amended as follows: 52 Delete lines 124 - 125 53 and insert: 54 Section 4.
