Florida Senate - 2019 SJR 284 By Senator Taddeo 40-00414-19 2019284__ 1 Senate Joint Resolution 2 A joint resolution proposing the creation of a new 3 section in Article X of the State Constitution to 4 require amending the state Medicaid plan to provide 5 Medicaid coverage to persons under age 65 who have an 6 income equal to or below 138 percent of the federal 7 poverty level. 8 9 Be It Resolved by the Legislature of the State of Florida: 10 11 That the following creation of a new section in Article X 12 of the State Constitution is agreed to and shall be submitted to 13 the electors of this state for approval or rejection at the next 14 general election or at an earlier special election specifically 15 authorized by law for that purpose: 16 ARTICLE X 17 MISCELLANEOUS 18 Medicaid expansion.— 19 (a) MEDICAID EXPANSION. The state Medicaid plan shall be 20 amended to provide Medicaid coverage to persons under age 65 21 with an income equal to or below 138 percent of the federal 22 poverty level. 23 (b) DUTIES OF THE STATE MEDICAID AGENCY AND THE GOVERNOR. 24 (1) No later than April 1, 2021, the state Medicaid agency 25 shall submit to the governor state plan amendments to expand 26 Medicaid coverage pursuant to subsection (a). 27 (2) No later than July 1, 2021, the governor shall review 28 the state plan amendments and provide comments to the state 29 Medicaid agency. 30 (3) No later than October 1, 2021, the state Medicaid 31 agency shall submit the state plan amendments and the governor’s 32 comments to the federal government. 33 (c) IMPLEMENTING LAW. Article VII, Section 19 does not 34 apply to any law implementing the expansion of Medicaid under 35 this section. 36 37 BE IT FURTHER RESOLVED that the following statement be 38 placed on the ballot: 39 CONSTITUTIONAL AMENDMENT 40 ARTICLE X 41 MEDICAID EXPANSION.—Requires amendment of the state 42 Medicaid plan to provide Medicaid coverage to persons under age 43 65 with an income equal to or below 138 percent of the federal 44 poverty level. Provides duties for the state Medicaid agency and 45 governor and requires state plan amendments to be submitted to 46 the federal government no later than October 1, 2021. Provides 47 that the requirements of Article VII, Section 19 do not apply to 48 any law implementing the expansion.
