Senator Thurston moved the following:
1 Senate Substitute for Amendment (925284) (with title
2 amendment)

4 Delete line 135
5 and insert:
6 Section 4. By July 1, 2019, the Agency for Health Care
7 Administration shall submit an amendment to this state’s Section
8 1115 Medicaid demonstration waiver to the Federal Government to
9 provide health care coverage through the statewide Medicaid
10 managed medical assistance program for adults 19 to 65 years of
11 age with family incomes up to 138 percent of the federal poverty
12 level and who do not otherwise qualify for Medicaid.
13 Section 5. This act shall take effect upon becoming a law.

16 And the title is amended as follows:
17 Delete lines 2 - 30
18 and insert:
19 An act relating to health care coverage; creating ss.
20 627.6046 and 627.65612, F.S.; defining the terms
21 “operative date” and “preexisting medical condition”
22 with respect to individual and group health insurance
23 policies, respectively; requiring insurers, contingent
24 upon the occurrence of either of two specified events,
25 to make at least one comprehensive major medical
26 health insurance policy available to all residents of
27 this state within a specified timeframe; prohibiting
28 such insurers from excluding, limiting, denying, or
29 delaying coverage under such policies due to
30 preexisting medical conditions; requiring such
31 policies to have been actively marketed on a specified
32 date and during a certain timeframe before that date;
33 providing applicability; amending s. 641.31, F.S.;
34 defining the terms “operative date” and “preexisting
35 medical condition” with respect to health maintenance
36 contracts; requiring health maintenance organizations,
37 contingent upon the occurrence of either of two
38 specified events, to make at least one comprehensive
39 major medical health maintenance contract available to
40 all residents of this state within a specified
41 timeframe; prohibiting such health maintenance
42 organizations from excluding, limiting, denying, or
43 delaying coverage under such contracts due to
44 preexisting medical conditions; requiring such
45 contracts to have been actively marketed on a
46 specified date and during a certain timeframe before
47 that date; requiring the Agency for Health Care
48 Administration, by a specified date, to submit an
49 amendment to this state’s Section 1115 Medicaid
50 demonstration waiver to the Federal Government to
51 provide health care coverage for certain adults
52 through the statewide managed medical assistance
53 program; providing an effective date.
