       The Committee on Rules (Harrell) recommended the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete everything after the enacting clause
    4  and insert:
    5         Section 1. Section 39.0012, Florida Statutes, is created to
    6  read:
    7         39.0012 Direct-support organization.—
    8         (1)The Department of Children and Families shall establish
    9  a direct-support organization to assist the Children and Youth
   10  Cabinet in carrying out its purposes and responsibilities
   11  primarily regarding fostering public awareness of children and
   12  youth issues and developing new partners in the effort to serve
   13  children and youth by raising money; submitting requests for and
   14  receiving grants from the federal government, the state or its
   15  political subdivisions, private foundations, and individuals;
   16  and making expenditures to or for the benefit of the cabinet.
   17  The sole purpose for the direct-support organization is to
   18  support the cabinet. Such a direct-support organization is an
   19  organization that is:
   20         (a)Incorporated under chapter 617 and approved by the
   21  Department of State as a Florida corporation not for profit;
   22         (b)Organized and operated to make expenditures to or for
   23  the benefit of the cabinet; and
   24         (c)Approved by the department to be operating for the
   25  benefit of and in a manner consistent with the goals of the
   26  cabinet and in the best interest of the state.
   27         (2)The board of directors of the direct-support
   28  organization shall consist of seven members. Each member of the
   29  board of directors shall be appointed to a 4-year term. The
   30  board of directors of the direct-support organization shall be
   31  appointed by the Governor.
   32         (3)The direct-support organization shall operate under
   33  written contract with the department.
   34         (4)All moneys received by the direct-support organization
   35  shall be deposited into an account of the direct-support
   36  organization and shall be used by the organization in a manner
   37  consistent with the goals of the cabinet.
   38         (5)This section is repealed October 1, 2024, unless
   39  reviewed and saved from repeal by the Legislature.
   40         Section 2. Subsection (4) of section 402.56, Florida
   41  Statutes, is amended to read:
   42         402.56 Children’s cabinet; organization; responsibilities;
   43  annual report.—
   44         (4) MEMBERS.—The cabinet shall consist of 17 16 members
   45  including the Governor and the following persons:
   46         (a)1. The Secretary of Children and Families;
   47         2. The Secretary of Juvenile Justice;
   48         3. The director of the Agency for Persons with
   49  Disabilities;
   50         4. The director of the Office of Early Learning;
   51         5. The State Surgeon General;
   52         6. The Secretary of Health Care Administration;
   53         7. The Commissioner of Education;
   54         8. The director of the Statewide Guardian Ad Litem Office;
   55         9. A representative The director of the Office of Adoption
   56  and Child Protection;
   57         10. A superintendent of schools, appointed by the Governor;
   58         11. A representative of the Florida Dental Association,
   59  appointed by the Governor; and
   60         12.11. Five members who represent children and youth
   61  advocacy organizations and who are not service providers,
   62  appointed by the Governor.
   63         (b) The President of the Senate, the Speaker of the House
   64  of Representatives, the Chief Justice of the Supreme Court, the
   65  Attorney General, and the Chief Financial Officer, or their
   66  appointed designees, shall serve as ex officio members of the
   67  cabinet.
   68         (c) The Governor or the Governor’s designee shall serve as
   69  the chair of the cabinet.
   70         (d) Nongovernmental members of the cabinet shall serve
   71  without compensation, but are entitled to receive per diem and
   72  travel expenses in accordance with s. 112.061 while in
   73  performance of their duties.
   74         Section 3. This act shall take effect on July 1, 2019.

   79  and insert:
   80                        A bill to be entitled                      
   81         An act relating to the Children and Youth Cabinet;
   82         creating s. 39.0012, F.S.; requiring the Department of
   83         Children and Families to establish direct-support
   84         organization to assist the Children and Youth Cabinet
   85         for a specified purpose; providing for membership of
   86         the direct-support organization’s board of directors;
   87         specifying that the direct-support organization shall
   88         operate under contract with the department; requiring
   89         moneys received by the direct-support organization to
   90         be deposited into a certain account; providing for
   91         repeal and legislative review of the direct-support
   92         organization; amending s. 402.56, F.S.; revising the
   93         membership of the Children and Youth Cabinet within
   94         the Executive Office of the Governor to include a
   95         representative from the Office of Adoption and Child
   96         Protection, rather than the director of the office,
   97         and a representative of the Florida Dental Association
   98         appointed by the Governor; providing an effective
   99         date.
