House Comm: RCS . 03/07/2019 . . . . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— The Committee on Innovation, Industry, and Technology (Gibson) recommended the following: 1 Senate Amendment to Amendment (110020) (with title 2 amendment) 3 4 Delete lines 31 - 64 5 and insert: 6 Article I of the State Constitution and that the recording and 7 transcript of such a meeting be made confidential and exempt 8 from disclosure under s. 119.07(1) and s. 24(a), Art. I of the 9 State Constitution: 10 (a) Information related to the security of the technology, 11 processes, or practices of the utility which are designed to 12 protect the utility’s networks, computers, programs, and data 13 from attack, damage, or unauthorized access, and which 14 information, if disclosed, would facilitate the alteration, 15 disclosure, or destruction of such data or information 16 technology resources. 17 (b) Information related to the security of existing or 18 proposed information technology systems or industrial control 19 technology systems of the utility, and which information, if 20 disclosed, would facilitate unauthorized access to and 21 alteration or destruction of such systems in a manner that would 22 adversely impact the safe and reliable operation of the systems 23 and utility. 24 (2) The Legislature finds that, as utility system 25 infrastructure becomes more connected and integrated through 26 information and communications technology, the exposure to 27 damage from attacks through such technology grows. These attacks 28 may result in the disruption of utility services and damage to 29 utility systems. Maintaining safe and reliable utility systems 30 is vital to protecting the public health and safety and to 31 ensuring the economic well-being of this state. 32 (3) The Legislature finds that the public and private harm 33 in disclosing the information made exempt by this act outweighs 34 any public benefit derived from the disclosure of such 35 information. The protection of information and communications 36 made exempt by this act will ensure that utilities have greater 37 safeguards to protect against security threats and will bolster 38 efforts to develop more resilient information technology systems 39 and industrial control technology systems. 40 (4) Therefore, the Legislature finds that it is a public 41 necessity to make such information exempt from public meetings 42 requirements and to make the recording and transcript thereof 43 confidential and exempt from public records requirements. 44 45 ================= T I T L E A M E N D M E N T ================ 46 And the title is amended as follows: 47 Delete line 72 48 and insert: 49 An act relating to public records and public meetings; 50 amending s.
