       Senator Brandes moved the following:
       
    1         Senate Amendment to Amendment (498526) (with title
    2  amendment)
    3  
    4         Between lines 5 and 6
    5  insert:
    6         Section 1. Subsection (6) is added to section 336.02,
    7  Florida Statutes, to read:
    8         336.02 Responsibility for county road system; approval of
    9  maps of reservation; limitation on certain local regulation.—
   10         (6) Notwithstanding any general law or special act, the
   11  ordinances, resolutions, or regulations of any municipality or
   12  special district, including any instrumentality thereof, do not
   13  apply to any transportation use, including any existing or
   14  future transportation facilities, structures, or appurtenances
   15  thereto, on the State Highway System as defined in s.
   16  334.03(24), on the county road system as defined in s.
   17  334.03(8), or on the city street system as defined in s.
   18  334.03(3), which is constructed, operated, or maintained, in
   19  whole or in part, with discretionary sales surtax funds levied
   20  pursuant to s. 212.055(1) in a charter county whose buildable
   21  land area is at least 80 percent incorporated area and includes
   22  at least 25 municipalities. This limitation includes the design,
   23  construction, erection, alteration, modification, repair, or
   24  demolition of any public transportation buildings or structures,
   25  and the governing body of the county levying the discretionary
   26  sales surtax shall be responsible for the review of all plans,
   27  specifications, and inspections required for the issuance of any
   28  permits pursuant to s. 553.79.

   34         An act relating to discretionary sales surtaxes;
   35         amending s. 336.02, F.S.; providing that municipal or

   37         regulations do not apply to certain transportation
   38         uses using charter county and regional transportation
   39         system surtax proceeds in certain counties; providing
   40         that the governing bodies of such counties are
   41         responsible for certain plans, specifications, and
   42         inspections; amending s.
