1 A bill to be entitled
2 An act relating to a review under the Open Government
3 Sunset Review Act; amending s. 790.0601, F.S.,
4 relating to an exemption from public records
5 requirements for personal identifying information of
6 an individual who has applied for a license to carry a
7 concealed weapon or firearm through a tax collector
8 appointed by the Department of Agriculture and
9 Consumer Services to receive applications and fees;
10 abrogating the scheduled repeal of the exemption;
11 providing an effective date.

13 Be It Enacted by the Legislature of the State of Florida:

15 Section 1. Section 790.0601, Florida Statutes, is amended
16 to read:
17 790.0601 Public records exemption for concealed weapons.—
18 (1) Personal identifying information of an individual who
19 has applied for or received a license to carry a concealed
20 weapon or firearm pursuant to s. 790.06 held by the Division of
21 Licensing of the Department of Agriculture and Consumer Services
22 is confidential and exempt from s. 119.07(1) and s. 24(a), Art.
23 I of the State Constitution. This exemption applies to such
24 information held by the division before, on, or after the
25 effective date of this section.
26 (2) Personal identifying information of an individual who
27 has applied for a license to carry a concealed weapon or firearm
28 pursuant to s. 790.0625 which is held by a tax collector
29 appointed by the Department of Agriculture and Consumer Services
30 to receive applications and fees is confidential and exempt from
31 s. 119.07(1) and s. 24(a), Art. I of the State Constitution.
32 This exemption applies to such information held by the tax
33 collector before, on, or after the effective date of this
34 subsection.
35 (3) Information made confidential and exempt by this
36 section shall be disclosed:
37 (a) With the express written consent of the applicant or
38 licensee or his or her legally authorized representative.
39 (b) By court order upon a showing of good cause.
40 (c) Upon request by a law enforcement agency in connection
41 with the performance of lawful duties, which shall include
42 access to any automated database containing such information
43 maintained by the Department of Agriculture and Consumer
44 Services.
45 (4) Subsection (2) is subject to the Open Government Sunset
46 Review Act in accordance with s. 119.15 and shall stand repealed
47 on October 2, 2019, unless reviewed and saved from repeal
48 through reenactment by the Legislature.
49 Section 2. This act shall take effect October 1, 2019.
