1 A bill to be entitled
2 An act relating to fracking; amending s. 377.19, F.S.;
3 defining the term “fracking”; creating s. 377.2405,
4 F.S.; prohibiting fracking in this state; providing
5 that permits for drilling or operating a well do not
6 authorize fracking; providing an effective date.

8 Be It Enacted by the Legislature of the State of Florida:

10 Section 1. Present subsections (5) through (32) of section
11 377.19, Florida Statutes, are redesignated as subsections (6)
12 through (33), respectively, and a new subsection (5) is added to
13 that section, and present subsection (5) of that section is
14 amended, to read:
15 377.19 Definitions.—As used in ss. 377.06, 377.07, and
16 377.10-377.40, the term:
17 (5) “Fracking” means all stages of a well intervention
18 performed by injecting large volumes of fluids at a high rate
19 into a rock formation at pressures that exceed the fracture
20 gradient of the rock formation in order to propagate hydraulic
21 fractures. The term does not include other well intervention
22 techniques, including conventional well stimulation or
23 conventional workover procedures; techniques used for routine
24 well cleanout work, well maintenance, or removal of formation
25 damage due to drilling or production; or conventional acidizing
26 techniques used to enhance, maintain, or restore the natural
27 permeability of the formation.
28 (6)(5) “Gas” means all natural gas, including casinghead
29 gas, and all other hydrocarbons not defined as oil in subsection
30 (16) (15).
31 Section 2. Section 377.2405, Florida Statutes, is created
32 to read:
33 377.2405 Fracking.—Fracking is prohibited in this state. A
34 permit for drilling or operating a well does not authorize
35 fracking.
36 Section 3. This act shall take effect July 1, 2019.
