The Committee on Appropriations (Hooper) recommended the
following:
1 Senate Amendment (with title amendment)

3 Delete lines 637 - 678
4 and insert:
5 Section 5. Subsection (4) of section 250.34, Florida
6 Statutes, is amended to read:
7 250.34 Injury or death on state active duty.—
8 (4) Each member of the Florida National Guard who is
9 killed, or who dies as the result of injuries incurred, while on
10 state active duty under competent orders and while engaged in
11 the performance of the member’s official duties qualifies for
12 benefits as a law enforcement officer under ss. pursuant to s.
13 112.19 and 112.1912 or any successor statute providing for death
14 benefits for law enforcement officers, and the decedent’s
15 survivors or estate are entitled to the death benefits provided
16 in ss. s. 112.19 and 112.1912. However, this section does not
17 prohibit survivors or the estate of the decedent from presenting
18 a claim bill for approval by the Legislature in addition to the
19 death benefits provided in this section. Each member of the
20 Florida National Guard who is killed, or who dies as the result
21 of injuries incurred, while on active duty qualifies for
22 benefits as a member of the United States Armed Forces under s.
23 295.061, and the decedent’s survivors or estate are entitled to
24 the death benefits provided in s. 295.061.
