       Senator Albritton moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Between lines 65 and 66
    4  insert:
    5         Section 2. Paragraph (d) of subsection (2) of section
    6  39.201, Florida Statutes, is amended, and paragraph (l) is added
    7  to that subsection, to read:
    8         39.201 Mandatory reports of child abuse, abandonment, or
    9  neglect; mandatory reports of death; central abuse hotline.—
   10         (2)
   11         (d) If the report is of an instance of known or suspected
   12  child abuse, abandonment, or neglect which that occurred out of
   13  state and the alleged perpetrator and the child alleged to be a
   14  victim live out of state, the central abuse hotline may shall
   15  not accept the report or call for investigation unless the child
   16  is currently being evaluated in a medical facility in this
   17  state.
   18         1. If the child is currently being evaluated in a medical
   19  facility in this state, the central abuse hotline shall accept
   20  the report or call for investigation and shall transfer the
   21  information on the report or call to the appropriate state or
   22  country.
   23         2. If the child is not currently being evaluated in a
   24  medical facility in this state, the central abuse hotline, but
   25  shall transfer the information on the report to or call to the
   26  appropriate state or country.
   27         (l) The department shall initiate an investigation when it
   28  receives a report from an emergency room physician.
   29         Section 3. Paragraph (i) is added to subsection (4) of
   30  section 39.303, Florida Statutes, to read:
   31         39.303 Child Protection Teams and sexual abuse treatment
   32  programs; services; eligible cases.—
   33         (4) The child abuse, abandonment, and neglect reports that
   34  must be referred by the department to Child Protection Teams of
   35  the Department of Health for an assessment and other appropriate
   36  available support services as set forth in subsection (3) must
   37  include cases involving:
   38         (i) A child who does not live in this state who is
   39  currently being evaluated in a medical facility in this state.

   43         Delete lines 2 - 3
   44  and insert:
   45         An act relating to child welfare; amending s. 39.01,
   46         F.S.; revising the definition of the term
   47         “institutional child abuse or neglect”; amending s.
   48         39.201, F.S.; requiring the central abuse hotline to
   49         accept certain reports or calls for investigation for
   50         children who do not live in this state; requiring the
   51         Department of Children and Families to initiate an
   52         investigation when a report is received from an
   53         emergency room physician; amending s. 39.303, F.S.;
   54         expanding the types of reports that the department
   55         must refer to Child Protection Teams; amending s.
   56         39.4015, F.S.; deleting the definition of the term
   57         “fictive kin”; amending s.
