Subsection (8) is added to section 57.105, 10 Florida Statutes, to read: 11 57.105 Attorney’s fee; sanctions for raising unsupported 12 claims or defenses; exceptions; service of motions; damages for 13 delay of litigation.— 14 (8) Attorney fees may not be awarded under this section in 15 proceedings for an injunction for protection pursuant to s. 16 784.046 or s. 784.0485, unless the court finds by clear and 17 convincing evidence that the petitioner knowingly made a false 18 statement or allegation in the petition in regard to a material 19 matter as defined in s. 837.011(3). 20 Section 2. Section 1. This act shall take effect July 1, 21 2019.
