       The Committee on Innovation, Industry, and Technology (Gibson)
       recommended the following:
       
    1         Senate Amendment to Amendment (672276) (with title
    2  amendment)

    4         Between lines 327 and 328
    5  insert:
    6         Section 6. Subsections (1) and (4) of section 553.504,
    7  Florida Statutes, are amended to read:
    8         553.504 Exceptions to applicability of the federal
    9  standards.—Notwithstanding the adoption of the Americans with
   10  Disabilities Act Standards for Accessible Design pursuant to s.
   11  553.503, all buildings, structures, and facilities in this state
   12  must meet the following additional requirements if such
   13  requirements provide increased accessibility:
   14         (1) All new or altered public buildings and facilities,
   15  private buildings and facilities, places of public
   16  accommodation, vacation rentals as defined in s. 509.242(1)(c)
   17  licensed after January 1, 2020, and commercial facilities, as
   18  those terms are defined by the standards, subject to this part,
   19  must comply with this part.
   20         (4) In motels and hotels a number of rooms equaling at
   21  least 5 percent of the guest rooms minus the number of
   22  accessible rooms required by the standards, and in the case of a
   23  vacation rental as defined in s. 509.242(1)(c) licensed after
   24  January 1, 2020, at least one bedroom and one bathroom, must
   25  provide the following special accessibility features:
   26         (a) Grab rails in bathrooms and toilet rooms that comply
   27  with s. 604.5 of the standards.
   28         (b) All beds in designed accessible guest rooms must be an
   29  open-frame type that allows the passage of lift devices.
   30         (c) Water closets that comply with section 604.4 of the
   31  standards.

   33  All buildings, structures, or facilities licensed as a hotel,
   34  motel, or condominium pursuant to chapter 509 are subject to
   35  this subsection, as are vacation rentals as defined in s.
   36  509.242(1)(c) licensed after January 1, 2020. This subsection
   37  does not relieve the owner of the responsibility of providing
   38  accessible rooms in conformance with ss. 224 and 806 of the
   39  standards.
