6 Section 10. Paragraph (r) and present paragraph (u) of
7 subsection (2) of section 409.815, Florida Statutes, are amended
8 to read:
9 409.815 Health benefits coverage; limitations.—
10 (2) BENCHMARK BENEFITS.—In order for health benefits
11 coverage to qualify for premium assistance payments for an
12 eligible child under ss. 409.810-409.821, the health benefits
13 coverage, except for coverage under Medicaid and Medikids, must
14 include the following minimum benefits, as medically necessary.
15 (r) Lifetime maximum.—Health benefits coverage obtained
16 under ss. 409.810-409.820 shall pay an enrollee’s covered
17 expenses at a lifetime maximum of $1 million per covered child.
18 (t)(u) Enhancements to minimum requirements.—
19 1. This section sets the minimum benefits that must be
20 included in any health benefits coverage, other than Medicaid or
21 Medikids coverage, offered under ss. 409.810-409.821. Health
22 benefits coverage may include additional benefits not included
23 under this subsection, but may not include benefits excluded
24 under paragraph (r) (s).
25 2. Health benefits coverage may extend any limitations
26 beyond the minimum benefits described in this section.

28 Except for the Children’s Medical Services Network, the agency
29 may not increase the premium assistance payment for either
30 additional benefits provided beyond the minimum benefits
31 described in this section or the imposition of less restrictive
32 service limitations.
