House Comm: RCS . 04/08/2019 . . . . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— The Committee on Commerce and Tourism (Gruters) recommended the following: 1 Senate Amendment (with title amendment) 2 3 Delete everything after the enacting clause 4 and insert: 5 Section 1. Section 542.336, Florida Statutes, is created to 6 read: 7 542.336 Invalid restrictive covenants.—A restrictive 8 covenant entered into with a physician licensed under chapter 9 458 or chapter 459 who practices a medical specialty in a county 10 where one entity employs or contracts with, either directly or 11 through related or affiliated entities, all physicians who 12 practice such specialty in that county is not supported by a 13 legitimate business interest and is void and unenforceable. Such 14 restrictive covenant shall remain void and unenforceable for 3 15 years after the date on which a second entity that employs or 16 contracts with, either directly or through related or affiliated 17 entities, one or more physicians who practice such specialty 18 begins serving patients in that county. 19 Section 2. This act shall take effect July 1, 2019. 20 21 ================= T I T L E A M E N D M E N T ================ 22 And the title is amended as follows: 23 Delete everything before the enacting clause 24 and insert: 25 A bill to be entitled 26 An act relating to restrictive covenants; creating s. 27 542.336, F.S.; providing that certain restrictive 28 covenants are void and unenforceable for a specified 29 period; providing an effective date.
