House Comm: RS . 04/19/2019 . . . . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— The Committee on Appropriations (Brandes) recommended the following: 1 Senate Amendment (with title amendment) 2 3 Delete lines 358 - 384 4 and insert: 5 627.749 Autonomous vehicles; insurance requirements.— 6 (1) DEFINITIONS.—As used in this section, the term: 7 (a) “Automated driving system” has the same meaning as in 8 s. 316.003. 9 (b) “Autonomous vehicle” has the same meaning as provided 10 in s. 316.003(3). 11 (c) “Fully autonomous vehicle” has the same meaning as 12 provided in s. 316.003(3). 13 (d) “On-demand autonomous vehicle network” has the same 14 meaning as provided in s. 316.003. 15 (2) INSURANCE REQUIREMENTS.— 16 (a) A fully autonomous vehicle with the automated driving 17 system engaged while logged on to an on-demand autonomous 18 vehicle network or engaged in a prearranged ride must be covered 19 by a policy of automobile insurance which provides: 20 1. Primary liability coverage of at least $1 million for 21 death, bodily injury, and property damage; 22 2. Personal injury protection benefits that meet the 23 minimum coverage amounts required under ss. 627.730-627.7405; 24 and 25 3. Uninsured and underinsured vehicle coverage as required 26 by s. 627.727. 27 (b) The coverage requirements of paragraph (a) may be 28 satisfied by any of the following: 29 1. Automobile insurance maintained by the owner of a fully 30 autonomous vehicle with the automated driving system engaged 31 while logged on to an on-demand autonomous vehicle network or 32 engaged in a prearranged ride; 33 2. Automobile insurance maintained by the on-demand 34 autonomous vehicle network; or 35 3. A combination of subparagraphs 1. and 2. 36 (3) ADDITIONAL COVERAGE REQUIREMENTS.— 37 (a) For purposes of compliance with chapter 324, the owner 38 or registrant of an autonomous vehicle, when the vehicle is not 39 subject to subsection (2), must furnish proof of ability to 40 respond in damages for the owner’s or registrant’s liability on 41 account of crashes arising out of the use of a motor vehicle: 42 1. In the amount of $1 million because of bodily injury to, 43 or death of, one person in any one crash; 44 2. Subject to such limits for one person, in the amount of 45 $1 million because of bodily injury to, or death of, two or more 46 persons in any one crash; 47 3. In the amount of $1 million because of injury to, or 48 destruction of, property of others in any one crash; and 49 4. With respect to commercial motor vehicles and nonpublic 50 sector buses that are autonomous vehicles, in the amounts 51 specified in ss. 627.7415 and 627.742, respectively. 52 (b) This subsection is repealed on January 1, 2025. 53 54 ================= T I T L E A M E N D M E N T ================ 55 And the title is amended as follows: 56 Delete lines 50 - 52 57 and insert: 58 terms; providing insurance requirements for fully 59 autonomous vehicles and coverage requirements for 60 autonomous vehicles; providing for future repeal of 61 specified coverage requirements;
