Section 324.033, Florida Statutes, is created 6 to read: 7 324.033 Manner of proving financial responsibility; 8 autonomous vehicles.— 9 (1) Notwithstanding s. 324.021 or any other provision of 10 law, the owner of a fully autonomous vehicle is deemed the 11 operator of the vehicle while operating in autonomous mode and 12 is fully liable for any damage caused by the autonomous vehicle. 13 All fully autonomous vehicles must be insured by a motor vehicle 14 liability policy which provides uninsured and underinsured 15 vehicle coverage as required by s. 627.727, personal injury 16 protection coverage as provided by s. 627.736, and liability 17 coverage that insures the owner in the amount of at least 18 $500,000 for combined bodily injury liability and property 19 damage liability or at least: 20 (a) One hundred thousand dollars for bodily injury to, or 21 the death of, one person in any one accident; 22 (b) Subject to such limits for one person, $300,000 for 23 bodily injury to, or the death of, two or more persons in any 24 one accident; and 25 (c) Fifty thousand dollars for damage to, or destruction 26 of, the property of others in any one accident. 27 (2) Notwithstanding subsection (1), the owner or operator 28 of an autonomous vehicle, as defined in s. 316.003(3), which is 29 used commercially for the pickup or delivery of passengers or 30 goods or for providing other services for compensation, except 31 in the circumstance of a digital network connecting a user to a 32 driver or an autonomous vehicle, must be insured by a motor 33 vehicle liability policy which provides all of the following: 34 (a) Primary automobile liability coverage which insures the 35 owner in the amount of at least $2 million for death, bodily 36 injury, and property damage. 37 (b) Personal injury protection benefits that meet the 38 minimum coverage required under ss. 627.730 - 627.7405. 39 (c) Uninsured and underinsured vehicle coverage as required 40 by s. 627.727. 41 (3) Nothing in this act is construed to limit or diminish 42 any right to recover damages caused by autonomous vehicles under 43 Florida statutory or common law. 44 45 ================= T I T L E A M E N D M E N T ================ 46 And the title is amended as follows: 47 Delete line 33 48 and insert: 49 322.015, F.S.; providing applicability; creating s. 50 324.033, F.S.; requiring the owner of a fully 51 autonomous vehicle to be deemed the operator of the 52 vehicle while operating in autonomous mode and to be 53 fully liable for certain damages; providing insurance 54 requirements for fully autonomous vehicles; providing 55 insurance requirements for certain owners or operators 56 of autonomous vehicles used commercially for the 57 pickup or delivery of passengers or goods or for 58 providing other services for compensation; providing 59 an exception; providing construction; amending ss.
