Senator Brandes moved the following:
1 Senate Amendment to Amendment (913868) (with title
2 amendment)

4 Delete lines 24 - 36
5 and insert:
6 (a) A mother’s breastfeeding of her baby;
7 (b) An individual who is merely naked at any place provided
8 or set apart for that purpose, including, but not limited to, a
9 clothing-optional or naturalist beach; or
10 (c) An inmate incarcerated at a state correctional
11 institution or local detention facility does not under any
12 circumstance violate this section.
13 Section 2. By September 1, 2020, the Division of State
14 Parks of the Department of Environmental Protection and the
15 Florida Tourism Industry Marketing Corporation shall jointly
16 hold a public hearing to consider options to expand clothing
17 optional or naturalist beaches in this state. By October 1,
18 2020, the division shall amend rule 62D-2.014(7)(b), Florida
19 Administrative Code, to comply with this act.
20 Section 3. Paragraph (e) is added to subsection (9) of
21 section 901.15, Florida Statutes, to read:
22 901.15 When arrest by officer without warrant is lawful.—A
23 law enforcement officer may arrest a person without a warrant
24 when:
25 (9) There is probable cause to believe that the person has
26 committed:
27 (e) An exposure of sexual organs in violation of s. 800.03.
28 Section 4. Except as otherwise expressly provided in this
29 act and except for this section, which shall take effect July 1,
30 2020, this act shall take effect October 1, 2020.

33 And the title is amended as follows:
34 Delete lines 46 - 51
35 and insert:
36 offense; providing exceptions to the unlawful exposure
37 of sexual organs; requiring the Division of State
38 Parks of the Department of Environmental Protection
39 and the Florida Tourism Industry Marketing Corporation
40 to jointly hold a public hearing by a specified date
41 to consider options to expand clothing-optional or
42 naturalist beaches; requiring the division to amend a
43 certain rule by a specified date; amending s. 901.15,
44 F.S.; authorizing warrantless arrests when a law
45 enforcement officer has probable cause to believe that
46 a person has violated s. 800.03, F.S.; providing
47 effective dates.
