Florida Senate - 2020 SB 1086 By Senator Diaz 36-01596-20 20201086__ 1 A bill to be entitled 2 An act relating to vehicle and vessel registration 3 data and functionality; amending ss. 320.03 and 4 328.73, F.S.; requiring the Department of Highway 5 Safety and Motor Vehicles to provide tax collectors 6 and their approved agents and vendors with real-time 7 access to certain vehicle and vessel registration data 8 and functionality in the same manner as provided to 9 other third parties; authorizing the department to 10 require a memorandum of understanding; providing an 11 effective date. 12 13 Be It Enacted by the Legislature of the State of Florida: 14 15 Section 1. Paragraph (b) of subsection (4) of section 16 320.03, Florida Statutes, is amended to read: 17 320.03 Registration; duties of tax collectors; 18 International Registration Plan.— 19 (4) 20 (b) The Florida Real Time Vehicle Information System shall 21 be installed in every tax collector’s and license tag agent’s 22 office in accordance with a schedule established by the 23 department in consultation with the tax collectors and 24 contingent upon funds being made available for the system by the 25 state. For the purpose of enhancing customer services provided 26 by tax collectors on behalf of the department, the department 27 shall provide tax collectors and their approved agents and 28 vendors with real-time access to the same data and functionality 29 that all other third parties receive from the department related 30 to motor vehicle and mobile home registration certificates, 31 registration license plates, and validation stickers, including, 32 but not limited to, each applicant’s current residential address 33 and each applicant’s current electronic mail address collected 34 pursuant to s. 320.95. The department may require a tax 35 collector’s approved agent or vendor that requests data or 36 functionality pursuant to this paragraph to enter into a 37 memorandum of understanding, which may not be more restrictive 38 than any memorandum of understanding between the department and 39 any other third-party vendor. 40 Section 2. Subsection (1) of section 328.73, Florida 41 Statutes, is amended to read: 42 328.73 Registration; duties of tax collectors.— 43 (1) The tax collectors in the counties of the state, as 44 authorized agents of the department, shall issue registration 45 certificates and vessel numbers and decals to applicants, 46 subject to the requirements of law and in accordance with rules 47 of the department. For the purpose of enhancing customer 48 services provided by tax collectors on behalf of the department, 49 the department shall provide tax collectors and their approved 50 agents and vendors with real-time access to the same data and 51 functionality that all other third parties receive from the 52 department related to vessel registration certificates and 53 vessel numbers and decals, including, but not limited to, each 54 applicant’s current residential address and each applicant’s 55 current electronic mail address collected pursuant to s. 328.30. 56 The department may require a tax collector’s approved agent or 57 vendor that requests data or functionality pursuant to this 58 subsection to enter into a memorandum of understanding, which 59 may not be more restrictive than any memorandum of understanding 60 between the department and any other third-party vendor. 61 Section 3. This act shall take effect July 1, 2020.
