Paragraph (a) of subsection (7) of section 6 316.008, Florida Statutes, is amended to read: 7 316.008 Powers of local authorities.— 8 (7)(a) A county or municipality may enact an ordinance to 9 permit, control, or regulate the operation of vehicles, golf 10 carts, mopeds, motorized scooters, electric bicycles, and 11 electric personal assistive mobility devices on sidewalks or 12 sidewalk areas when such use is permissible under federal law. 13 The ordinance must restrict such vehicles or devices to a 14 maximum speed of 15 miles per hour in such areas. 15 Section 7. Section 316.20655, Florida Statutes, is created 16 to read: 17 316.20655 Electric bicycle regulations.— 18 (1) Except as otherwise provided in this section, an 19 electric bicycle or an operator of an electric bicycle shall be 20 afforded all the rights and privileges, and be subject to all of 21 the duties, of a bicycle or the operator of a bicycle, including 22 those identified in s. 316.2065. An electric bicycle is a 23 vehicle to the same extent as a bicycle. However, this section 24 may not be construed to prevent a local government, through the 25 exercise of its powers under s. 316.008, from adopting an 26 ordinance governing the operation of electric bicycles on 27 streets, highways, sidewalks, and sidewalk areas that are under 28 the local government’s jurisdiction. 29 30 ================= T I T L E A M E N D M E N T ================ 31 And the title is amended as follows: 32 Delete lines 14 - 19 33 and insert: 34 sidewalks and bicycle paths; amending s. 316.008, 35 F.S.; authorizing a county or municipality to enact an 36 ordinance regulating the operation of electric 37 bicycles on sidewalks or sidewalk areas when such use 38 is permissible under federal law; restricting the 39 speed of electric bicycles in such areas; creating s. 40 316.20655, F.S.; providing electric bicycle 41 regulations; providing for rights and privileges of 42 electric bicycles and operators of electric bicycles; 43 providing that electric bicycles are vehicles to the 44 same extent as bicycles; providing construction; 45 providing that electric bicycles and
