Florida Senate - 2020 SB 1196 By Senator Cruz 18-01521-20 20201196__ 1 A bill to be entitled 2 An act relating to coverage for epinephrine injectors 3 for children; creating ss. 627.64161 and 627.65791, 4 F.S.; defining the term “epinephrine injector”; 5 requiring certain individual and group health 6 insurance policies, respectively, to provide coverage 7 for epinephrine injectors prescribed by the treating 8 physician as medically necessary for an insured’s 9 family member 18 years of age or younger; amending s. 10 641.31, F.S.; defining the term “epinephrine 11 injector”; requiring certain health maintenance 12 contracts to provide coverage for epinephrine 13 injectors prescribed by the treating physician as 14 medically necessary for a subscriber’s family member 15 18 years of age or younger; providing an effective 16 date. 17 18 Be It Enacted by the Legislature of the State of Florida: 19 20 Section 1. Section 627.64161, Florida Statutes, is created 21 to read: 22 627.64161 Coverage for epinephrine injectors for children.— 23 (1) As used in this section, the term “epinephrine 24 injector” includes: 25 (a) An epinephrine auto-injector, as defined in s. 26 381.88(2), which is approved by the United States Food and Drug 27 Administration for the administration of epinephrine into the 28 human body; and 29 (b) A single-use, prefilled syringe that contains a 30 premeasured dose of epinephrine equivalent to the dosage used in 31 an epinephrine auto-injector and that is approved by the United 32 States Food and Drug Administration for the administration of 33 epinephrine into the human body. 34 (2) A health insurance policy that provides major medical 35 coverage for a family member of the insured must provide 36 coverage for epinephrine injectors prescribed by the treating 37 physician as medically necessary for an insured’s family member 38 18 years of age or younger. 39 Section 2. Section 627.65791, Florida Statutes, is created 40 to read: 41 627.65791 Coverage for epinephrine injectors for children.— 42 (1) As used in this section, the term “epinephrine 43 injector” has the same meaning as in s. 627.64161. 44 (2) A group health insurance policy that provides major 45 medical coverage for a family member of the insured must provide 46 coverage for epinephrine injectors prescribed by the treating 47 physician as medically necessary for an insured’s family member 48 18 years of age or younger. 49 Section 3. Subsection (48) is added to section 641.31, 50 Florida Statutes, to read: 51 641.31 Health maintenance contracts.— 52 (48)(a) As used in this subsection, the term “epinephrine 53 injector” has the same meaning as in s. 627.64161. 54 (b) A health maintenance contract that provides major 55 medical coverage for a family member of the subscriber must 56 provide coverage for epinephrine injectors prescribed by the 57 treating physician as medically necessary for a subscriber’s 58 family member 18 years of age or younger. 59 Section 4. This act shall take effect January 1, 2021.
