House Comm: RCS . 02/28/2020 . . . . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— The Committee on Appropriations (Rouson) recommended the following: 1 Senate Amendment 2 3 Delete lines 413 - 449 4 and insert: 5 1. The department, community based care lead agencies, 6 sheriff offices and their contracted providers shall report all 7 allegations of suspected or known violations of ethical or 8 professional misconduct standards to the department approved 9 third party credentialing entity, including all allegations made 10 to the departments Office of Inspector General on certified 11 personnel. 12 2. The department shall review all case records involving 13 death of a child or other critical incident that is subject to a 14 Critical Incident Rapid Response Team review to ensure 15 compliance with ethical and professional conduct requirements of 16 any certified child welfare professional staff. 17 3. The department shall provide any reports to the third 18 party credentialing entity that indicate that ethical or 19 professional conduct requirements were not met so that the 20 credentialing entity may determine if the individual’s 21 certification requires suspension or revocation. 22 4. If it is determined that the individual’s certification 23 requires suspension or revocation the department or employer of 24 the certified staff must immediately remove the individual from 25 their duties that require certification as a condition of 26 employment. 27 5. Any decision by a department approved credentialing 28 entity to deny, revoke, or suspend a certification, or otherwise 29 impose sanctions on an individual who is certified, is 30 reviewable by the department. Upon receiving an adverse 31 determination, the person aggrieved may request an 32 administrative hearing pursuant to ss. 120.569 and 120.57(1) 33 within 30 days after completing any appeals process offered by 34 the credentialing entity or the department, as applicable. 35 6. The third-party credentialing entity shall track and 36 report compliance with this subsection to the department. 37
