    1                        A bill to be entitled                      
    2         An act relating to trust funds; creating s. 16.631,
    3         F.S.; creating the Ocoee Election Day Riots Descendant
    4         Compensation Trust Fund within the Department of Legal
    5         Affairs; specifying the purpose and the funding source
    6         of the trust fund; requiring the department to
    7         administer the trust fund; providing for the carrying
    8         forward of undisbursed funds; providing for future
    9         review and termination or re-creation of the trust
   10         fund; providing an appropriation; providing a
   11         contingent effective date.

   13  Be It Enacted by the Legislature of the State of Florida:
   14  
   15         Section 1. Section 16.631, Florida Statutes, is created to
   16  read:
   17         16.631 Ocoee Election Day Riots Descendant Compensation
   18  Trust Fund.—
   19         (1) The Ocoee Election Day Riots Descendant Compensation
   20  Trust Fund is created within the Department of Legal Affairs.
   21         (2) The trust fund is established for use as a depository
   22  for funds to be used for the Ocoee Election Day Riots Descendant
   23  Compensation Fund Program established under s. 16.63.
   24         (3) The trust fund shall consist of funds appropriated by
   25  the Legislature for the purpose of compensating claimants under
   26  s. 16.63.
   27         (4) The department shall administer the trust fund.
   28         (5) Notwithstanding s. 216.301 and pursuant to s. 216.351,
   29  any balance in the trust fund at the end of any fiscal year
   30  shall remain in the trust fund at the end of the year and shall
   31  be available for carrying out the purposes of the trust fund.
   32         (6) In accordance with s. 19(f)(2), Art. III of the State
   33  Constitution, the trust fund shall, unless terminated sooner, be
   34  terminated July 1, 2024. Before its scheduled termination, the
   35  trust fund shall be reviewed as provided in s. 215.3206(1) and
   36  (2).
   37         Section 2. For the 2020-2021 fiscal year, the nonrecurring
   38  sum of $25 million is appropriated from the General Revenue Fund
   39  to the Ocoee Election Day Riots Descendant Compensation Trust
   40  Fund to be used as prescribed in s. 16.63, Florida Statutes.
   41         Section 3. This act shall take effect on the same date that
   42  SB ___ or similar legislation takes effect, if such legislation
   43  is adopted in the same legislative session or an extension
   44  thereof and becomes a law.
