1 A bill to be entitled
2 An act relating to trust funds; creating s. 16.631,
3 F.S.; creating the Ocoee Election Day Riots Descendant
4 Compensation Trust Fund within the Department of Legal
5 Affairs; specifying the purpose and the funding source
6 of the trust fund; requiring the department to
7 administer the trust fund; providing for the carrying
8 forward of undisbursed funds; providing for future
9 review and termination or re-creation of the trust
10 fund; providing a contingent effective date.

12 Be It Enacted by the Legislature of the State of Florida:

14 Section 1. Section 16.631, Florida Statutes, is created to
15 read:
16 16.631 Ocoee Election Day Riots Descendant Compensation
17 Trust Fund.—
18 (1) The Ocoee Election Day Riots Descendant Compensation
19 Trust Fund is created within the Department of Legal Affairs.
20 (2) The trust fund is established for use as a depository
21 for funds to be used for the Ocoee Election Day Riots Descendant
22 Compensation Fund Program established under s. 16.63.
23 (3) The trust fund shall consist of funds appropriated by
24 the Legislature for the purpose of compensating claimants under
25 s. 16.63.
26 (4) The department shall administer the trust fund.
27 (5) Notwithstanding s. 216.301 and pursuant to s. 216.351,
28 any balance in the trust fund at the end of any fiscal year
29 shall remain in the trust fund at the end of the year and shall
30 be available for carrying out the purposes of the trust fund.
31 (6) In accordance with s. 19(f)(2), Art. III of the State
32 Constitution, the trust fund shall, unless terminated sooner, be
33 terminated July 1, 2024. Before its scheduled termination, the
34 trust fund shall be reviewed as provided in s. 215.3206(1) and
35 (2).
36 Section 2. This act shall take effect on the same date that
37 SB 1262 or similar legislation takes effect, if such legislation
38 is adopted in the same legislative session or an extension
39 thereof and becomes a law.
