Florida Senate - 2020 SJR 1364 By Senator Rodriguez 37-01590A-20 20201364__ 1 Senate Joint Resolution 2 A joint resolution proposing an amendment to Sections 3 2 and 4 of Article IX of the State Constitution, 4 relating to the State Board of Education, school 5 districts, and school boards, to provide that school 6 boards shall, subject to Article I, Section 6 of the 7 State Constitution, set the wages, hours, and terms 8 and conditions of employment for all school board 9 employees. 10 11 Be It Resolved by the Legislature of the State of Florida: 12 13 That the following amendment to Sections 2 and 4 of Article 14 IX of the State Constitution is agreed to and shall be submitted 15 to the electors of this state for approval or rejection at the 16 next general election or at an earlier special election 17 specifically authorized by law for that purpose: 18 ARTICLE IX 19 EDUCATION 20 SECTION 2. State board of education.— 21 The state board of education shall be a body corporate and, 22 except as provided in Section 4(b), have such supervision of the 23 system of free public education as is provided by law. The state 24 board of education shall consist of seven members appointed by 25 the governor to staggered 4-year terms, subject to confirmation 26 by the senate. The state board of education shall appoint the 27 commissioner of education. 28 SECTION 4. School districts; school boards.— 29 (a) Each county shall constitute a school district; 30 provided, two or more contiguous counties, upon vote of the 31 electors of each county pursuant to law, may be combined into 32 one school district. In each school district there shall be a 33 school board composed of five or more members chosen by vote of 34 the electors in a nonpartisan election for appropriately 35 staggered terms of four years, as provided by law. 36 (b) The school board shall operate, control and supervise 37 all free public schools within the school district; subject to 38 Article I, Section 6, shall set the wages, hours, and terms and 39 conditions of employment for all school board employees; and 40 shall determine the rate of school district taxes within the 41 limits prescribed herein. Two or more school districts may 42 operate and finance joint educational programs. 43 BE IT FURTHER RESOLVED that the following statement be 44 placed on the ballot: 45 CONSTITUTIONAL AMENDMENT 46 ARTICLE IX, SECTIONS 2 and 4 47 STATE BOARD OF EDUCATION, SCHOOL DISTRICTS, AND SCHOOL 48 BOARDS.—Proposing an amendment to the State Constitution to 49 provide that, subject to Article I, Section 6 of the State 50 Constitution, the school board within each school district, 51 rather than the State Board of Education, shall set the wages, 52 hours, and terms and conditions of employment for all school 53 board employees.
