Florida Senate - 2020 SB 1384 By Senator Albritton 26-01568-20 20201384__ 1 A bill to be entitled 2 An act relating to the Florida Farm to School Program; 3 amending s. 595.406, F.S.; requiring vendors selling 4 or delivering agricultural commodities to school 5 districts in the Florida Farm to School Program to 6 provide the school districts with an invoice that 7 meets certain requirements, beginning on a specified 8 date; requiring each participating district school 9 board to submit the information monthly to the 10 Department of Agriculture and Consumer Services; 11 requiring the department to create and manage a 12 sortable database for the information; requiring the 13 department to submit an annual report to the 14 Legislature; authorizing the department to adopt 15 rules; providing an effective date. 16 17 Be It Enacted by the Legislature of the State of Florida: 18 19 Section 1. Subsection (4) is added to section 595.406, 20 Florida Statutes, to read: 21 595.406 Florida Farm to School Program.— 22 (4)(a) Beginning July 1, 2020, each vendor who sells or 23 delivers agricultural commodities, as defined in s. 573.103, to 24 a school district under the Florida Farm to School Program must 25 provide an invoice to the school district which is in a sortable 26 format specified by the department and which includes the 27 following information: 28 1. The facility that produced the agricultural commodity; 29 2. The National Resources Conservation Services Federal 30 Information Processing Standards code to identify the county and 31 state where the facility is located; 32 3. The type of agricultural commodity delivered; 33 4. The total weight or volume of the agricultural commodity 34 delivered; and 35 5. The total value of the agricultural commodity delivered. 36 (b) Each district school board shall submit the information 37 it receives from vendors pursuant to paragraph (a) to the 38 department each month to be included in a sortable database that 39 is created and maintained by the department. The information 40 must include the total amount of agricultural commodities 41 delivered by location, the agricultural commodity type, the 42 weight or volume of the agricultural commodity, and the total 43 cost per item. 44 (c) By September 1 of each year, the department shall 45 submit a report summarizing the information in the database to 46 the President of the Senate and the Speaker of the House of 47 Representatives. The report must include, for each school 48 district, the total number of agricultural commodities purchased 49 by weight or volume and the percentage of each individual 50 agricultural commodity purchased by weight or volume, and the 51 cost for each to the state. 52 (d) The department may adopt rules to implement this 53 subsection. 54 Section 2. This act shall take effect upon becoming a law.
