Florida Senate - 2020 CS for SB 1398 By the Committee on Rules; and Senator Flores 595-03556-20 20201398c1 1 A bill to be entitled 2 An act relating to community planning; amending s. 3 120.525, F.S.; providing requirements for establishing 4 a quorum for meetings of certain councils when a 5 voting member appears via telephone, real-time 6 videoconferencing, or similar real-time electronic or 7 video communication; requiring the member to give 8 notice of intent to appear via telephone, real-time 9 videoconferencing, or similar real-time electronic or 10 video communication by a specified time; amending s. 11 163.3168, F.S.; requiring the Department of Economic 12 Opportunity to give a preference to certain counties 13 and municipalities when selecting applications for 14 funding for technical assistance; providing an 15 effective date. 16 17 Be It Enacted by the Legislature of the State of Florida: 18 19 Section 1. Subsection (4) is added to section 120.525, 20 Florida Statutes, to read: 21 120.525 Meetings, hearings, and workshops.— 22 (4) For purposes of establishing a quorum at meetings of 23 regional planning councils that cover three or more counties, a 24 voting member who appears via telephone, real-time 25 videoconferencing, or similar real-time electronic or video 26 communication that is broadcast publicly at the meeting location 27 may be counted toward the quorum requirement if at least one 28 third of the voting members of the regional planning council are 29 physically present at the meeting location. A member must 30 provide oral, written, or electronic notice of his or her intent 31 to appear via telephone, real-time videoconferencing, or similar 32 real-time electronic or video communication to the regional 33 planning council at least 24 hours before the scheduled meeting. 34 Section 2. Present subsection (4) of section 163.3168, 35 Florida Statutes, is redesignated as subsection (5), and a new 36 subsection (4) is added to that section, to read: 37 163.3168 Planning innovations and technical assistance.— 38 (4) When selecting applications for funding for technical 39 assistance, the state land planning agency shall give a 40 preference to a county that has a population of 200,000 or less, 41 and to a municipality located within such a county, for 42 assistance in determining whether the area in and around a 43 proposed multiuse corridor interchange as described in s. 44 338.2278 contains appropriate land uses and natural resource 45 protections and for aid in developing or amending a local 46 government’s comprehensive plan to provide for such uses, 47 protections, and intended benefits as provided in s. 338.2278. 48 Section 3. This act shall take effect July 1, 2020.
