       Senator Book moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Between lines 24 and 25
    4  insert:
    5         (3) The Legislature does not intend for the application of
    6  this section to supersede any current prohibition against the
    7  use of fireworks contained within a legally executed and
    8  properly recorded declaration of covenants or covenant running
    9  with the land of any homeowners’ association pursuant to chapter
   10  720. However, a homeowners’ association, through a board of
   11  administrators, a board of directors, or a governing body, may
   12  not promulgate rules or regulations that attempt to abrogate an
   13  individual’s right to use fireworks during a designated holiday
   14  or under any other law of this state.

   17  And the title is amended as follows:
   18         Delete line 6
   19  and insert:
   20         construction; providing legislative intent;
   21         prohibiting homeowners’ associations from promulgating
   22         certain rules or regulations; providing an effective
   23         date.
