5 Section 2. Subsection (4) of section 215.322, Florida
6 Statutes, is amended to read:
7 215.322 Acceptance of credit cards, charge cards, debit
8 cards, or electronic funds transfers by state agencies, units of
9 local government, and the judicial branch.—
10 (4) To ensure competition, the Chief Financial Officer
11 shall may establish contracts with one or more than one
12 financial institution institutions, credit card company
13 companies, or other entity entities that may lawfully provide
14 such services, in a manner consistent with chapter 287, for
15 processing credit card, charge card, debit card, or electronic
16 funds transfer collections for deposit into the State Treasury
17 or another qualified public depository. Any state agency, or the
18 judicial branch, which accepts payment by credit card, charge
19 card, debit card, or electronic funds transfer may shall use at
20 least one of the contractors established by the Chief Financial
21 Officer, or unless the state agency or judicial branch may
22 obtains authorization from the Chief Financial Officer to use
23 another contractor that it determines is more advantageous to
24 the state agency or the judicial branch. The contracts may
25 authorize a unit of local government to use the services upon
26 the same terms and conditions for deposit of credit card, charge
27 card, debit card, or electronic funds transfer transactions into
28 its qualified public depositories.

37 for certain funds transfers; deleting a requirement
38 for state agencies and the judicial branch to obtain
39 authorization from the Chief Financial Officer before
40 using another contractor for processing certain
41 payments; amending s.
