    1                        A bill to be entitled                      
    2         An act relating to fossil fuel combustion products in
    3         landfills; amending ss. 403.7047, 403.706, and
    4         403.7222, F.S.; prohibiting a landfill in this state
    5         from receiving fossil fuel combustion products;
    6         providing an effective date.

    8  Be It Enacted by the Legislature of the State of Florida:
    9  
   10         Section 1. Subsection (5) is added to section 403.7047,
   11  Florida Statutes, to read:
   12         403.7047 Regulation of fossil fuel combustion products.—
   13         (5) Notwithstanding this section, a landfill in this state
   14  may not receive fossil fuel combustion products.
   15         Section 2. Present subsection (22) of section 403.706,
   16  Florida Statutes, is redesignated as subsection (23) and a new
   17  subsection (22) is added to that section, to read:
   18         403.706 Local government solid waste responsibilities.—
   19         (22) Notwithstanding any other law to the contrary, a
   20  landfill in this state may not receive fossil fuel combustion
   21  products.
   22         Section 3. Subsection (5) is added to section 403.7222,
   23  Florida Statutes, to read:
   24         403.7222 Prohibition of hazardous waste landfills.—
   25         (5) Notwithstanding subsection (4), a landfill in this
   26  state may not receive fossil fuel combustion products.
   27         Section 4. This act shall take effect upon becoming a law.
