1 A bill to be entitled
2 An act relating to specialty license plates; amending
3 s. 320.08058, F.S.; directing the Department of
4 Highway Safety and Motor Vehicles to develop a
5 Highwaymen license plate; providing for distribution
6 and use of fees collected from the sale of the plates;
7 providing a contingent effective date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Subsection (85) is added to section 320.08058,
12 Florida Statutes, to read:
13 320.08058 Specialty license plates.—
14 (85) HIGHWAYMEN LICENSE PLATES.—
15 (a) The department shall develop a Highwaymen license plate
16 as provided in this section and s. 320.08053. The plate must
17 bear the colors and design approved by the department. The word
18 “Florida” must appear at the top of the plate, and the word
19 “Highwaymen” must appear at the bottom of the plate.
20 (b) The annual use fees shall be distributed to the City of
21 Fort Pierce, subject to a city resolution designating the city
22 as the fiscal agent of the license plate. The city may use up to
23 10 percent of the fees for administrative costs and marketing of
24 the plate and shall use the remainder of the fees as follows:
25 1. Before completion of construction of the Highwaymen
26 Museum and African-American Cultural Center, the city shall
27 distribute at least 15 percent to the St. Lucie Education
28 Foundation, Inc., to fund art education and art projects in
29 public schools within St. Lucie County. The remainder of the
30 fees shall be used by the city to fund the construction of the
31 Highwaymen Museum and African-American Cultural Center.
32 2. Upon completion of construction of the Highwaymen Museum
33 and African-American Cultural Center, the city shall distribute
34 at least 10 percent to the St. Lucie Education Foundation, Inc.,
35 to fund art education and art projects in public schools within
36 St. Lucie County. The remainder of the fees shall be used by the
37 city to fund the day-to-day operations of the Highwaymen Museum
38 and African-American Cultural Center.
39 Section 2. This act shall take effect October 1, 2020, but
40 only if SB 1456 or similar legislation takes effect, if such
41 legislation is adopted in the same legislative session or an
42 extension thereof and becomes a law.
