    1                        A bill to be entitled                      
    2         An act relating to acquisition of certain professional
    3         services; amending s. 287.055, F.S.; providing that
    4         the Consultants’ Competitive Negotiation Act may not
    5         be construed to prevent cooperative purchasing between
    6         governmental agencies if certain criteria are met;
    7         providing an effective date.

    9  Be It Enacted by the Legislature of the State of Florida:
   10  
   11         Section 1. Paragraph (d) of subsection (4) of section
   12  287.055, Florida Statutes, is amended to read:
   13         287.055 Acquisition of professional architectural,
   14  engineering, landscape architectural, or surveying and mapping
   15  services; definitions; procedures; contingent fees prohibited;
   16  penalties.—
   17         (4) COMPETITIVE SELECTION.—
   18         (d) Nothing in This act may not shall be construed to
   19  prohibit a continuing contract between a firm and an agency or
   20  to prevent cooperative purchasing between governmental agencies
   21  otherwise subject to this act if the following criteria are met:
   22         1. The originating agency has procured professional
   23  services in accordance with this act.
   24         2. The professional services to be provided to the
   25  originating agency are for a project in which the secondary
   26  agency has a coordinated scope of work to be performed at the
   27  same time for efficiency and to avoid conflicts in design and
   28  work effort.
   29         3. The procurement policies of the secondary agency permit
   30  cooperative procurement.
   31         Section 2. This act shall take effect July 1, 2020.
