Florida Senate - 2020 SJR 1674 By Senator Farmer 34-01798-20 20201674__ 1 Senate Joint Resolution 2 A joint resolution proposing the creation of Section 3 22 in Article III and a new section in Article XII of 4 the State Constitution to require a supermajority of 5 each house to approve a general law preempting a 6 subject of legislation to the state. 7 8 Be It Resolved by the Legislature of the State of Florida: 9 10 That the following creation of Section 22 in Article III 11 and a new section in Article XII of the State Constitution are 12 agreed to and shall be submitted to the electors of this state 13 for approval or rejection at the next general election or at an 14 earlier special election specifically authorized by law for that 15 purpose: 16 ARTICLE III 17 LEGISLATURE 18 SECTION 22. Preemption to the state.—The legislature may 19 not, except by a general law passed by a two-thirds vote of each 20 house, preempt to the state a field of regulation or other 21 subject of legislation not preempted to it by this Constitution. 22 23 ARTICLE XII 24 SCHEDULE 25 Preemption to the state.—This section and Section 22 of 26 Article III, which requires approval by a supermajority vote of 27 each house of the legislature for a general law that preempts a 28 subject of legislation to the state, shall take effect January 29 1, 2022. 30 31 BE IT FURTHER RESOLVED that the following statement be 32 placed on the ballot: 33 CONSTITUTIONAL AMENDMENT 34 ARTICLE III, SECTION 22 35 ARTICLE XII 36 LEGISLATIVE PREEMPTION.—Proposing an amendment to the State 37 Constitution, to take effect on January 1, 2022, to prohibit the 38 Legislature from preempting to the state any subject of 39 legislation unless approved by a two-thirds vote of each house.
